Terms and Conditions
Scope
These Terms and Conditions ("Terms") govern your use of the Photone – Grow Light Meter app and its related services, such as the guides ("app"). The app is provided by Lightray Innovation GmbH, Steinackerstrasse 38, 8542 Wiesendangen, Switzerland ("we"). You accept these Terms when you first start the app. Our Privacy Policy explains how we handle your data.
If you download the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Apple and Google are not parties to these Terms and are not responsible for the app.
License
We grant you a non-transferable right to use the app for your own purposes. All rights to the app, its content, and our trademarks remain with us or our licensors.
You may not use the app unlawfully or abusively, circumvent its security features, or decompile or replicate it, unless the law expressly permits this.
Measurement Accuracy
We have tested the app on numerous devices and strive for measurements that are as accurate as possible. However, accuracy also depends on factors beyond our control, e.g., your device's sensors, the environment, and how the app is handled. If you need absolute accuracy, verify important measurements with a calibrated meter.
Content and Links
We create the information in the app and in the guides with care, but we can't guarantee that it is complete, up to date, and error-free. We are not responsible for the content of third-party websites or apps we link to.
Photone Pro
Photone Pro is an optional subscription. Purchase, payment, renewal, and cancellation are handled through the Apple App Store or Google Play and are additionally subject to their terms.
- Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. The renewal is charged within the last 24 hours of the current period at the then-current price.
- You can cancel your subscription at any time in your Apple Account or Google Account. It remains active until the end of the paid period.
- Refunds are requested from Apple or Google. There are no refunds for unused periods unless the store's terms or mandatory law provide otherwise.
Photone Pro includes email support. We usually answer requests within 24 hours but can't guarantee this in every case. All users also have access to the guides in the app and on our website.
Warranty
We provide the app as is. To the extent permitted by law, we make no warranty that the app is always available, error-free, or suitable for your purposes. This does not apply to fraudulently concealed defects or where the law mandates a warranty.
Liability
We are liable without limitation for damages we cause intentionally or through gross negligence, for personal injury, and where we are liable under mandatory law, e.g., the Swiss Product Liability Act.
Otherwise, to the extent permitted by law, we are not liable for indirect or consequential damages such as lost profits or data loss, and our liability is limited to the amount you paid for the app. This also applies to our employees and agents.
The app stores your measurements and settings on your device. You are responsible for backing them up.
Changes
We may amend these Terms. We will inform you about material changes in the app. If you continue to use the app afterwards, the new version applies. If you don't agree, you can stop using the app and cancel your subscription.
Final Provisions
If any provision of these Terms is invalid, the remaining provisions remain in effect.
You may transfer rights and obligations under these Terms to third parties only with our written consent. We may transfer them as part of a sale or merger of our company.
These Terms are governed by Swiss law. The place of jurisdiction is the registered office of Lightray Innovation GmbH. If you are a consumer, the mandatory consumer protection provisions and places of jurisdiction of your country of residence remain reserved.
